VewMe LLC ("VewMe") is committed to complying with, and where applicable enforcing, the requirements of 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. § 75 ("Section 2257"). This notice describes VewMe's position with respect to Section 2257 in light of the white-label creator-business platform that VewMe operates at vewme.com and on Creator Sites powered by VewMe (collectively, the "Platform").
As set out in the VewMe Terms of Service, Community Guidelines, and Acceptable Content Policy, the Platform is a SFW (safe-for-work) creator platform. VewMe does not permit pornography, sexually explicit imagery, video, audio, text, livestreams, or related material, and does not permit content whose primary purpose is to sexually arouse. Any such content uploaded to the Platform is in violation of VewMe's policies and is subject to removal, account suspension or termination, and reporting to appropriate authorities.
To the extent that any visual depiction of actual sexually explicit conduct, as defined in 18 U.S.C. § 2256, may appear on or be contained within the Platform notwithstanding VewMe's prohibitions, all persons who appear in any such visual depiction were over the age of eighteen (18) years at the time the visual image was created.
VewMe LLC, as the owner and operator of the Platform, is not the "producer," as that term is defined in 18 U.S.C. § 2257 and subsequent case law, of any visual content uploaded to the Platform by Users. All Users that upload content to the Platform are required to adhere to and comply with 18 U.S.C. § 2257 to the extent it applies to their content, in addition to all of VewMe's policies prohibiting sexually explicit material.
Pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), VewMe reserves the right to remove, restrict, or disable any content posted by Users that VewMe deems to be indecent, obscene, sexually explicit, defamatory, unlawful, or otherwise inconsistent with its Terms of Service, Community Guidelines, Acceptable Content Policy, or applicable law.
Each User who uploads content to the Platform is solely responsible for ensuring that the content complies with VewMe's policies and with all applicable laws and regulations, including Section 2257 to the extent it applies. By uploading content to the Platform, the uploading User:
agrees to act as the custodian of records for that content, as required by applicable law, including 18 U.S.C. § 2257 to the extent applicable;
warrants that all individuals depicted in the content are at least eighteen (18) years of age at the time the content was created, and that the User has verified and retained records of their age and identity in accordance with applicable law;
warrants that the User has all necessary rights, licenses, consents, and releases required to upload, publish, and distribute the content on the Platform; and
agrees to indemnify and hold VewMe harmless from any claims arising out of the User's breach of the foregoing, in accordance with the VewMe Terms of Service.
Any records required to be maintained by federal law relating to visual depictions on the Platform shall be made available to authorized inspectors by the applicable Records Custodian. Inquiries regarding records associated with content depicted on the Platform may be directed to:

VewMe reserves all rights and defenses available to it under applicable law, including without limitation the provisions of 47 U.S.C. § 230 and 17 U.S.C. § 512.
